Excess emissions from malfunction, startup or shutdown are violations, but (except for NSPS and NESHAP limits, Title IV and VI limits, EPA PSD/NSR permits, R18-2-715(F) and certain PSD permit conditions) the owner has an affirmative defence to civil or administrative penalties if the R18-2-310.01 reports were made and the owner shows, for malfunctions, a sudden unavoidable breakdown, good maintenance and operation, expeditious repairs using overtime where practicable, minimised amount and duration, steps to limit ambient impact, no recurring pattern, no attributable ambient exceedance, no foreseeable cause, monitors kept running and contemporaneous records; and, for startup and shutdown, that the emissions could not be prevented by planning and design and any bypass was unavoidable to prevent loss of life, injury or severe damage, with the same minimisation, monitoring and record showings.
