Arizona Air Quality Regulations (ADEQ / ARS Title 49 / AAC Title 18 Chapter 2) R18-2-306.E: R18-2-306(E): emergency affirmative defense for technology-based limits

An emergency (sudden, reasonably unforeseeable events beyond the source's control requiring immediate corrective action, not caused by poor design, lack of preventive maintenance, careless operation or operator error) is an affirmative defence to exceeding a technology-based limit only if properly signed contemporaneous operating logs or other evidence show the cause, proper operation at the time, all reasonable steps to minimise excess emissions, and notice to the director by certified mail, fax or hand delivery within two working days describing the emergency, mitigation and corrective action; the permittee bears the burden of proof.
