The employer must take an employee off lead-risk work immediately if biological monitoring shows a blood lead level at or above the removal level, which since the second anniversary of S.R. No. 71/2018 (r 199(1A)) is 1.45 micromoles per litre (30 micrograms per decilitre) for men and women not of reproductive capacity, and 0.48 micromoles per litre (10 micrograms per decilitre) for women of reproductive capacity. Immediate removal is also required where a registered medical practitioner, after an examination, considers the employee must be removed, or where there is an indication that controls have failed so that the removal level is likely to be reached or exceeded. (The earlier r 199(1) levels were 2.41, 0.97 and, for pregnant or breastfeeding women, 0.72 micromoles per litre.) The duty extends to independent contractors and supports sections 21 and 23 of the Act.
