An employer must not permit any employee to carry out high risk work without a licence of the appropriate class for that work. The duty is breached by allowing the work, not only by directing it, so employers need a system that checks each employee's licence class before assigning Schedule 3 work. Breach carries up to 100 penalty units (natural person) or 500 (body corporate). The exceptions in r 130 (including trainees under direct supervision, persons working under r 138 and Authority exemptions under r 538(2)) and interstate licence recognition under r 131 apply.
