No person may, without lawful excuse, act recklessly in a way that puts, or could put, another person at a workplace at risk of serious injury. This is an indictable offence. An individual faces imprisonment for up to 5 years, a fine up to 1800 penalty units, or both; for a body corporate the ceiling is a fine of 20 000 penalty units. It may be heard and determined summarily under the Criminal Procedure Act 2009 (s 28).
