Victoria Occupational Health and Safety Act 2004 s21-2-c: s 21(2)(c) Maintain workplaces under the employer's control in a safe condition

An employer breaches s 21(1) if it fails to keep each workplace it manages and controls safe and free of health risks, as far as reasonably practicable. This covers the physical condition of premises and sites: floors and access ways, lighting, ventilation, housekeeping, electrical installations, edges and openings, and emergency exits. Maximum penalty for the underlying s 21(1) offence: 1800 penalty units (individual) or 9000 penalty units (body corporate).
