Victoria Occupational Health and Safety Act 2004 s31: s 31 Installers, erectors and commissioners of plant: no unsafe installation

Where an installer, erector or commissioner of plant is aware, or should reasonably be aware, that the plant will be used in a workplace, that person must ensure as far as reasonably practicable that the manner of installation, erection or commissioning does not make the plant unsafe or a health risk to use. Commissioning includes the adjustments, tests and inspections needed before plant starts or restarts. Maximum penalty: 1800 penalty units (individual) or 9000 penalty units (body corporate). The offence is indictable (s 31(2)), though it may be heard summarily.
