Anyone designing a building, a structure, or a part of either, who is aware or should reasonably be aware that it will serve as a workplace, must ensure as far as reasonably practicable that the design makes it safe, and free of health risks, for the people working in it when it is used for its designed purpose. Maximum penalty: 500 penalty units (individual) or 2500 penalty units (body corporate). The offence is indictable (s 28(2)), though it may be heard summarily.
