Victoria Occupational Health and Safety Act 2004 s27-1-a: s 27(1)(a) Designers of plant: design for safe use

Where a plant designer is aware, or should reasonably be aware, that the plant will be used in a workplace, the designer must ensure as far as reasonably practicable that the design makes the plant safe and free of risks to health when used for a purpose it was designed for. Maximum penalty: 1800 penalty units (individual) or 9000 penalty units (body corporate). The offence is indictable (s 27(2)), though it may be heard summarily.
