Victoria Occupational Health and Safety Act 2004 s26: s 26 Persons with management or control of workplaces: safe workplace and access

A person who has management or control of a workplace to any extent, whether as owner or otherwise, must ensure, as far as reasonably practicable, that both the workplace and the ways in and out of it are safe and free of risks to health. The duty applies only to matters the person manages or controls (s 26(2)), so landlords, building owners, facility managers and principal contractors hold it for what they control. Maximum penalty: 1800 penalty units (individual) or 9000 penalty units (body corporate). The offence is indictable (s 26(3)), though it may be heard summarily.
