Victoria Occupational Health and Safety Act 2004 s25-1-a: s 25(1)(a) Employees: take reasonable care for own health and safety

While at work, an employee must take reasonable care for their own health and safety. Whether reasonable care was taken is judged against the employee's knowledge of the relevant circumstances (s 25(3)). Maximum penalty: 1800 penalty units. The offence is indictable (s 25(4)), though it may be heard and determined summarily under the Criminal Procedure Act 2009 (s 28).
