Victoria Occupational Health and Safety Act 2004 s23: s 23 Protect persons other than employees from risks from the undertaking

An employer must ensure, as far as reasonably practicable, that people who are not its employees, such as visitors, customers, members of the public, neighbours and other businesses' workers, are not exposed to health or safety risks arising from how the employer conducts its undertaking. Maximum penalty: 1800 penalty units (individual) or 9000 penalty units (body corporate). The offence is indictable (s 23(2)), though it may be heard and determined summarily under the Criminal Procedure Act 2009 (s 28).
