The SBA Lender declines businesses engaged in activity illegal under federal, state or local law, including any business that grows, processes, distributes or sells marijuana or its products, or sells devices primarily intended or marketed for marijuana use, even where state law allows it. For businesses selling hemp or CBD products or consumption devices, the Lender obtains documentation that the hemp meets the federal (Agricultural Marketing Act section 297A) and any stricter state definition, testing protocols for growers and processors, and evidence (including lab certificates) that CBD products comply with FDA and other federal, state and local rules.
