Every worker at work takes reasonable care of their own health and safety and that of anyone their acts or omissions affect, and cooperates with the employer as far as necessary so that statutory duties and requirements can be met; workers' representatives cooperate with the employer in every measure that eliminates or minimises risks. A worker reports immediately to a supervisor any situation they have reasonable grounds to think poses an imminent or serious threat to life or health, and the employer may not send the worker back into continuing imminent or serious danger until any remedial action needed has been taken. A worker who leaves a work situation they have reasonable grounds to think poses an imminent and serious threat to life or health is not punished or made to suffer undue consequences, so long as the Commissioner confirms the danger. An employer does not levy, or allow to be levied, any penalty on a worker for anything done or provided under the Act, and anyone who deliberately or recklessly tampers with or misuses anything provided for health, safety or welfare commits an offence.
