Every chief executive officer ensures, so far as reasonably practicable, that the duties the Act places on the employer are properly discharged. Without derogating from that responsibility or liability, the chief executive officer may assign any such duty to a person under their control, who acts subject to the chief executive officer's control and directions; the assignment does not relieve the employer of responsibility or liability (subject to section 37), and the head of a State department is deemed its chief executive officer.
