South Africa Occupational Health and Safety Act 85 of 1993
Sections 7 to 16: Policy and the general duties of employers, self-employed persons, manufacturers and suppliers, employees and chief executive officers – South Africa Occupational Health and Safety Act 85 of 1993

South Africa Occupational Health and Safety Act 85 of 1993 12: Duties regarding listed work: after consulting the health and safety committee, identify hazards and evaluate risks, prevent or minimise exposure, run an occupational hygiene programme and biological monitoring and apply medical surveillance, keep representatives informed, and release individual results only with written consent

What does 12 require?

An employer with employees doing listed work (work the Minister has declared under section 11), or who may be exposed to its hazards, must, subject to prescribed arrangements and after consulting the workplace health and safety committee, identify the hazards and weigh the risks to employees' health and the steps needed to comply with the Act; prevent exposure so far as reasonably practicable or, if prevention cannot reasonably be achieved, minimise it; and, taking into account what the risks are and how great the exposure is, run an occupational hygiene programme with biological monitoring and place the employees under medical surveillance. The employer keeps the health and safety representatives for the affected workplaces informed of the actions taken and their results, but individual monitoring and surveillance results are disclosed only with the employee's written consent to anyone except an inspector, the employer and the employee.
