Samoa Telecommunications Act 2005 33: Negotiate interconnection and facility access in good faith

On a written request from another service provider, a service provider must negotiate in good faith an agreement to connect and keep connected their networks and to give reasonably requested access to facilities such as central offices and switching sites, masts, towers, poles, subscriber lines and underground facilities (co-location being subject to section 68) (33(1)). Obstructing or delaying, refusing necessary information, misleading or coercing, interfering with a provider's communications with the Regulator (including through non-disclosure agreements) and refusing amendments for changed circumstances breach the duty (33(2)); a provider need not accept terms likely to cause material danger or damage, material interference with its facilities or services, or that are unreasonable technically or economically, unless the Regulator orders otherwise (33(3)).
