For every document that Subpart AA requires to be retained, the employer that retains it must produce that document when the Secretary of Labor or a person the Secretary designates asks for it. Examples of retained items are canceled entry permits kept for at least 1 year under 1926.1205(f) and training records kept for the period of employment under 1926.1207(d). The obligation falls on whichever employer holds the document, which on a multi-employer site may be the entry employer, the controlling contractor or the host employer. The section does not create a new retention period; it attaches a production duty to the retention duties set elsewhere in the subpart. In practice the employer needs an organised filing system so that permits, training records and certifications for a given site and period can be located and handed over promptly during an inspection.
