NSW Home Building Act 1989 s105X: ss 105X and 121C Supply information, claim details and scheme data to the Authority

The Authority may require a licence holder (including a former holder) by written notice to disclose information on its and related bodies' business and financial position, premiums, claims and their handling costs and settlement, building cover contracts and register particulars, and to produce documents, with certification by a tax agent, company auditor or approved actuary if required; failure is an offence unless compliance was not within its power (1,000 penalty units). The holder must forward details of each claim within the period the Authority specifies and further information for the s 102A register. Under s 121C the Authority may require data on building cover contracts, claims and the scheme, including personal and health information, from licence holders, former holders, brokers and agents (100 penalty units).
