NSW Home Building Act 1989 s105H: s 105H Licensed insurers and providers comply with licence conditions

A licence under Part 6C is subject to conditions prescribed by the Act or regulations and those imposed by the Authority (with Board approval) on grant or later, whether or not endorsed on the licence; a licence holder that contravenes any condition commits an offence (1,000 penalty units), and an unlicensed insurer or provider that breaches an obligation declared by the Act to be a licence condition also commits an offence. A holder cannot be both convicted and given a civil penalty for the same conduct. Declared conditions include paying Operational Fund contributions (s 103EG) and the business plan, re-insurance and investment disclosures (ss 105S to 105U).
