Minnesota Rules of the Board of Continuing Legal Education 12C: Returning from restricted to active status: notice, 125 dollar fee, catch-up hours or discretionary conditions, Board appeal

What does 12C require?

A lawyer on restricted status who wants active status notifies the Director in writing and pays a 125 dollar transfer fee. Transfer follows automatically once the lawyer has completed the hours that would have been required, pro rata, had the lawyer stayed active, or at the Director's discretion on lesser requirements, never fewer than 45 hours in the three years before transfer and never more than 90 hours specified, weighing the lawyer's past CLE hours, other educational activity, practice in another jurisdiction, law-related work, whether it was reasonable for the lawyer not to have foreseen the need for the hours, and any hardship or compelling reasons. The Director reports each transfer's terms to the Board. A lawyer who does not meet transfer conditions is returned to restricted status on mailed notice, and may ask the Board in writing to review the Director's transfer requirements.
