ITAR - International Traffic in Arms Regulations 120.5: Respect other agencies' jurisdiction when exporting EAR, nuclear and imported items with defense articles

What does 120.5 require?

Permanent imports of defense articles are controlled by the Attorney General on the U.S. Munitions Import List (27 CFR part 447) (120.5(a)). A State licence may also authorise EAR items, but an ITAR exemption may carry an EAR item only when it is for use in or with, and shipped with, a defense article; the EAR item remains under Commerce jurisdiction for later transactions (120.5(b)). The ITAR does not apply to Category VI, XV, XVI and XX items to the extent the Department of Energy or Nuclear Regulatory Commission controls them under the Atomic Energy Act, transfers of Restricted Data are prohibited except as that Act allows, and licences for Category VI(e) or XX(b)(1) naval nuclear propulsion items need an Agreement for Cooperation for Mutual Defense Purposes, save narrow exceptions (120.5(c)).
