ITAR - International Traffic in Arms Regulations 120.3: Treat an article as a defense article on its characteristics, not its intended use

What does 120.3 require?

A specific article or service is a defense article or defense service if it meets the criteria of a USML entry or provides the equivalent performance capabilities of a USML defense article; articles giving a critical military or intelligence advantage may be designated and placed in Category XXI; an article is not a defense article if a commodity jurisdiction determination has placed it under another agency or it meets one of the 'specially designed' release criteria of 120.41(b). The intended use of the article after export, military or civilian, is not by itself a factor in deciding whether it is ITAR-controlled (120.3). Organisations must therefore classify on technical characteristics and keep the evidence, including for commercial variants of military products.
