The lawyer's or firm's own money is not deposited in the trust account, with two exceptions. First, an amount reasonably sufficient to cover bank fees and charges that are the firm's responsibility (including charges that fall outside the defined allowable monthly service charges) may sit in the account. Second, where a payment belongs partly to the client and partly, now or potentially, to the firm, the whole payment goes into trust; the firm's share may be taken when it falls due, unless the client disputes the firm's entitlement, in which case the disputed part stays in trust until the dispute is finally resolved.
