For employees on an annual day-rate agreement (forfait en jours), where the collective agreement does not provide the arrangements of item 3 of L3121-64 II, the employer defines the arrangements for exercising the right to disconnect and communicates them by any means to the employees concerned; in undertakings of at least 50 employees they must conform to the charter of L2242-17 item 7. Paragraph I of the same article requires a control document of days or half-days worked, a check that the workload respects daily and weekly rest, and an annual interview.
