Telework is put in place under a collective agreement or, failing one, a charter drawn up by the employer after the opinion of the CSE where there is one. Without an agreement or charter, the employer and employee who agree to telework record their agreement by any means. A refusal of telework to a disabled worker or a carer, and a refusal to an employee in an eligible post under the agreement or charter, must be reasoned.
