EPA Risk Management Program (40 CFR Part 68) 68.87: § 68.87 Contractors

For contractors doing maintenance, repair, turnaround, major renovation or specialty work on or adjacent to a covered process (not incidental services such as janitorial, food, laundry or delivery), the owner or operator must obtain and evaluate information on the contractor's safety performance and programs when selecting it; inform the contractor of known fire, explosion or toxic release hazards of the work and process; explain the applicable emergency response provisions of Subpart E; develop and implement safe work practices controlling contractor entry, presence and exit in covered process areas; and periodically evaluate the contractor's performance. The contract owner or operator must train each contract employee in safe work practices, instruct them in the known hazards and the applicable emergency action plan, document training (identity, date and means of verifying understanding), ensure they follow the source's safety rules and safe work practices, and advise the owner or operator of unique hazards from its work or hazards it finds.
