The owner or operator must develop a written plan of action on employee participation, distribute an annual notice that the plan is available and how to access it, and train employees, representatives and management on it as needed; consult employees and their representatives on the conduct and development of PHAs and other process safety elements, and on addressing, correcting, resolving, documenting and implementing recommendations from PHAs, compliance audits and incident investigations; give employees knowledgeable in the process and their representatives authority to recommend to the operator in charge that an operation be partly or completely shut down because of the potential for a catastrophic release, and allow a qualified operator in charge to shut down an operation on that basis under the 68.69 procedures; implement a process for employees and representatives to report, anonymously or with attribution, to the owner and/or EPA unaddressed hazards, unreported 68.42(a) accidents and other noncompliance, keeping records of reports to the owner for three years; and provide access to PHAs and all other information developed under the part.
