RCRA permits are effective for a fixed term of no more than 10 years, not extendable by modification beyond that except under 270.51, and may be issued for shorter terms; each land disposal facility permit is reviewed five years after issuance or reissuance and modified as necessary. An expired EPA-issued permit continues in force until a new permit takes effect if the permittee submitted a timely, complete application and EPA, through no fault of the permittee, has not issued the new permit; continued permits remain fully enforceable, and for noncompliance EPA may enforce, move to deny the new permit (requiring the activities to cease), issue a new permit or take other action. In authorised states, continuation follows state law; standardized permits continue on the stated conditions.
