EPA RCRA Hazardous Waste Management 270.30: § 270.30 Conditions applicable to all permits

Every RCRA permit incorporates these conditions: (a) duty to comply, with noncompliance a violation and grounds for enforcement, termination, modification or denial of renewal; (b) duty to reapply to continue after expiry; (c) the need to halt or reduce activity is no defense; (d) duty to mitigate releases and adverse impacts from noncompliance; (e) proper operation and maintenance of all treatment and control systems, including adequate funding, staffing, training, laboratory and process controls and quality assurance, and back-up systems where needed; (f) permit actions for cause, not stayed by a permittee request; (g) no property rights conveyed; (h) duty to provide requested information and records; (i) inspection and entry by the Director to enter, access and copy records, inspect and sample at reasonable times; (j) representative monitoring, with records of monitoring (calibration, maintenance, strip charts), reports, the annual waste minimisation certification and application data kept at least three years (ground-water records for the active life and post-closure period), each recording the date, place and time, samplers, analysis dates, analysts, methods and results; (k) signature and certification of submissions under 270.11; (l) reporting: planned physical alterations as soon as possible; advance notice of changes that may cause noncompliance, with no waste handled in new or modified portions until a letter signed by the permittee and a registered PE certifying construction per the permit is submitted and the Director inspects or does not announce an inspection within 15 days; transfers only after notice; monitoring reports at permit intervals; compliance schedule reports within 14 days of each date; oral reports within 24 hours of noncompliance that may endanger health or the environment (endangerment to drinking water, releases, fires or explosions threatening outside the facility) with the seven listed items, followed by a written submission within 5 days (or a 15-day report if waived); manifest discrepancy reports when unresolved at 20 days (in e-Manifest from December 1, 2025); unmanifested waste reports within 15 days (electronically from December 1, 2025); the biennial report; other noncompliance reported with monitoring reports; and prompt correction of any incorrect or missing application or report information; (m) an information repository where the Director requires it.
