EPA RCRA Hazardous Waste Management 270.40: § 270.40 Transfer of permits

A permit may be transferred to a new owner or operator only after it is modified, or revoked and reissued, to identify the new permittee and add needed requirements. A change of ownership or operational control may be made as a Class 1 modification with the Director's prior written approval (or as a routine change for standardized permits); the new owner or operator must submit a revised permit application no later than 90 days before the scheduled change with a written agreement fixing the date for transfer of permit responsibility, and the old owner or operator must continue to meet the Subpart H financial requirements until the new one demonstrates compliance, which it must do within six months of the change.
