EPA RCRA Hazardous Waste Management 270.10: § 270.10 General application requirements (with 270.13 to 270.28)

Anyone required to have a permit (new applicants and those with expiring permits) must complete, sign and submit an application; where owner and operator differ the operator applies and the owner also signs (signatories under 270.11). No permit issues before a complete application. The application gives Part A information (270.13: the activities, facility name, address and latitude and longitude, SIC codes, operator and owner details, Indian lands, new or existing status, scale drawings and photographs, processes and design capacities, the hazardous wastes and estimated annual quantities, other environmental permits, a topographic map extending one mile beyond the boundary, the business and any hazardous debris categories) and Part B information (270.14 general requirements: facility description, chemical and physical analyses, waste analysis plan, security, inspection schedule, preparedness waivers, contingency plan, procedures to prevent hazards in unloading, run-off, water supply contamination, equipment failure and power outages, personnel exposure and air releases, ignitable and incompatible waste precautions, traffic, seismic and floodplain information, training, closure and post-closure plans with cost estimates and financial assurance, insurance, and a detailed topographic map; ground-water information for regulated units; and information on every solid waste management unit and any releases; plus the unit-specific requirements of 270.15 to 270.27 and post-closure requirements of 270.28). Existing facilities file Part A within six months of the rules that first apply to them or 30 days after first becoming subject, whichever comes first, and Part B when required (at least six months allowed; failure terminates interim status); new facilities may not begin physical construction without Parts A and B and a finally effective permit (PCB incinerators excepted); Part A must be amended for newly listed wastes and for 270.72 changes; reapplication is due at least 180 days before expiry (or a Notice of Intent for standardized permits); records of all application data must be kept three years from signature; landfill and surface impoundment Part B applications must include public exposure information; and combustion units may be asked for risk information where MACT compliance alone may not protect health and the environment.
