EPA RCRA Hazardous Waste Management 270.1: § 270.1 Purpose and scope (the RCRA permit requirement)

A RCRA permit is required for the treatment, storage and disposal of any hazardous waste identified or listed in Part 261, including injection wells and their surface facilities, TSD at facilities needing an NPDES permit (POTWs are permitted by rule under 270.60(c)) and barges or vessels for ocean disposal; owners and operators of units must have permits during the active life including closure, and land disposal units that received waste after July 26, 1982 or certified closure after January 26, 1983 need post-closure permits unless closure by removal or decontamination is demonstrated through the public-notice equivalency procedure (decided within 90 days) or an enforceable document is issued. No permit is required for generators accumulating under 262.14 to 262.17, farmers under 262.70, facilities managing only waste excluded by 261.4 or 262.14, totally enclosed treatment facilities, elementary neutralization and wastewater treatment units, transporters at transfer facilities for ten days or less, adding absorbent at first placement in a container (meeting 264.17(b), 264.171 and 264.172), universal waste handlers and transporters (batteries, pesticides, mercury-containing equipment, lamps, aerosol cans), reverse distributors under Part 266 Subpart P, and recyclers of ignitable spent refrigerants under Part 266 Subpart Q, nor for treatment or containment during immediate response to a discharge, threatened discharge or munitions emergency (activities continuing after the response need a permit; military responders keep three-year records).
