The initial generator must determine every applicable waste code to identify the treatment standards: the waste carries its listed codes and each characteristic code it exhibits (unless the listed standard operates in lieu of the characteristic one), and for a characteristic waste (other than D001 non-wastewaters treated by CMBST, RORGS or POLYM) the generator must determine its underlying hazardous constituents. Where a waste is both listed and characteristic, the listed standard applies in place of the characteristic one only if it covers the constituent causing the characteristic; otherwise the waste must meet both. No prohibited characteristic waste may be land disposed unless it meets the Subpart D standards. Characteristic wastes are subject to 268.7, except that once no longer hazardous, a one-time notification (the receiving Subtitle D facility and a description of the waste as generated, its codes, treatability groups and underlying hazardous constituents) and a certification in the 268.7(b)(4) wording (or (b)(4)(iv) where only the characteristic was removed) are placed in the generator's or treater's file and updated when the process or receiving facility changes.
