EPA RCRA Hazardous Waste Management 268.40: § 268.40 Applicability of treatment standards

A prohibited waste listed in the table "Treatment Standards for Hazardous Wastes" may be land disposed only if it meets the table's requirement for that waste, which is one of: total waste standards (all hazardous constituents in the waste or residue at or below the values), waste extract standards (constituents in the TCLP extract at or below the values), or a specified technology (268.42), with wastewater concentration standards based on any-one-day maximums (grab samples for D004 to D011) and non-wastewaters on grab samples. When wastes with different standards for a constituent are combined for treatment, the residue must meet the lowest standard. Facilities may demonstrate compliance with footnoted organic standards by using the combustion methods on which they were based and achieving detection limits within an order of magnitude of the standards, certified under 268.7. Characteristic wastes (D001 to D043) not managed in CWA, CWA-equivalent or Class I non-hazardous injection systems must also have all underlying hazardous constituents treated to the 268.48 universal treatment standards. The section also sets rules for particular F001 to F005 constituents, historic interim standards, previously stabilised mixed radioactive wastes, and alternative technologies for listed P and U wastes.
