EPA RCRA Hazardous Waste Management 268.50: § 268.50 Prohibitions on storage of restricted wastes

Storing hazardous wastes restricted from land disposal is prohibited except: by a generator in on-site tanks, containers or containment buildings solely to accumulate quantities needed for proper recovery, treatment or disposal while complying with 262.16, 262.17 and Parts 264 and 265; by a TSDF in tanks, containers or containment buildings solely for such accumulation, with each container marked with its contents, "Hazardous Waste", its waste codes, an indication of the hazards and the date each period of accumulation begins, and each tank marked with a description of contents, quantity received and dates, or with that information in the operating record; by a transporter at a transfer facility for ten days or less; and by healthcare facilities and reverse distributors accumulating pharmaceuticals under 266.502, 266.503 and 266.510. A TSDF may store for up to one year unless EPA shows the storage was not solely for accumulation, and beyond one year only if it proves that it was. The prohibition does not apply during an exemption from a prohibition, to wastes meeting the treatment standards or a variance, or to remediation waste in an approved staging pile; liquid wastes with 50 ppm or more PCBs must be stored at a facility meeting 40 CFR 761.65(b) and treated or disposed of within one year of first storage.
