No generator, transporter, handler or TSDF may dilute a restricted waste or treatment residual as a substitute for adequate treatment to meet the Subpart D standards, to circumvent or avoid a Subpart C prohibition, or to circumvent RCRA section 3004. Dilution of characteristic-only wastes is allowed in Clean Water Act permitted, CWA-equivalent or pretreatment systems that include land-based units (unless a specified method other than deactivation applies). Combustion of the metal-bearing waste codes in Appendix XI is prohibited unless, at generation or after bona fide treatment such as cyanide destruction, the waste has organics or cyanide above the 268.48 standards, is organic debris-like material contaminated with inorganic metal-bearing waste, has a heating value of at least 5,000 BTU per pound, is co-generated with wastes needing combustion, is subject to requirements to reduce organics (including biological agents), or contains more than 1 percent total organic carbon. Adding iron filings or other metallic iron to lead-containing wastes to meet a lead treatment standard is impermissible dilution.
