EPA RCRA Hazardous Waste Management 266.507: § 266.507 Residues of hazardous waste pharmaceuticals in empty containers

A stock bottle, dispensing bottle, vial or ampule (up to 1 litre or 10,000 pills) or a unit-dose container (packet, cup, wrapper, blister pack or delivery device) is empty, and its residue unregulated, once the pharmaceuticals are removed by the practices commonly used for that container; a syringe is empty when its plunger has been fully depressed; an IV bag is empty when fully administered or, for non-acute pharmaceuticals, empty under 261.7(b)(1). At healthcare facilities operating under Subpart P, non-empty syringes and IV bags go with their remaining contents into containers managed as non-creditable hazardous waste pharmaceuticals (subject also to sharps and medical waste rules), and residues in all other containers (inhalers, aerosol cans, nebulizers, tubes of ointments, gels or creams) are managed as non-creditable hazardous waste pharmaceuticals unless the container held non-acute pharmaceuticals and is empty under 261.7(b)(1) or (2).
