EPA RCRA Hazardous Waste Management 266-SubpartH: Part 266 Subpart H: Hazardous waste burned in boilers and industrial furnaces

Applies to hazardous waste burned or processed in boilers and industrial furnaces for energy or materials recovery or destruction, with exemptions (including used oil, certain metals recovery furnaces and small quantity burners) (266.100); once a unit demonstrates compliance with the Part 63 Subpart EEE MACT standards, most of these standards cease to apply. Generators and transporters of such waste follow Parts 262 and 263, and storage and treatment before burning follows Parts 264, 265, 267 and 270 (with a limited exemption for direct transfer and on-site storage) (266.101). Permitted burners must meet the listed Part 264 provisions, 270.22 and 270.66, with permit conditions on hazardous waste feed, organic, particulate, metals, HCl and chlorine emissions (266.102); interim status burners must certify precompliance and compliance, test and meet the same emission standards under interim status (266.103). The standards control organic emissions (destruction and removal efficiency of 99.99 percent, 99.9999 percent for dioxin-listed wastes, and carbon monoxide or hydrocarbon limits) (266.104), particulate matter (266.105), metals through tiered feed rate and emission screening limits (266.106) and HCl and chlorine (266.107). Small quantity on-site burners are exempt within the monthly quantity limits set by effective stack height, a firing rate of no more than 1 percent of total fuel and other conditions, with notification and records (266.108); low risk waste exemptions (266.109), DRE trial burn waivers for boilers (266.110), direct transfer standards (266.111) and the conditions under which residues keep the Bevill exclusion (266.112) complete the subpart.
