EPA RCRA Hazardous Waste Management 264.98: § 264.98 Detection monitoring program

Under detection monitoring the owner or operator must monitor the indicator parameters (such as specific conductance, total organic carbon or total organic halogen), waste constituents or reaction products the permit specifies, with a compliance-point well system meeting 264.97(a)(2), (b) and (c); sample per 264.97(g) and keep data in a form suitable for the statistical test; sample and test at the permit's frequencies; determine ground-water flow rate and direction at least annually; and determine, within the permit's time after sampling, whether there is statistically significant evidence of contamination at each compliance well. On such evidence it must notify the Regional Administrator in writing within seven days, immediately sample all wells for Part 264 Appendix IX constituents (or an approved subset), optionally resample within one month to confirm, apply within 90 days for a permit modification establishing compliance monitoring (with concentrations found, system and method changes and proposed concentration limits or notice of alternate limits) and within 180 days submit data for any alternate concentration limit and an engineering feasibility plan for corrective action (unless all constituents are Table 1 constituents below their values or alternate limits are sought for all). Alternatively it may, after seven-day notice, show within 90 days that another source or a sampling, analysis or evaluation error caused the result, applying for any needed modification and continuing detection monitoring. If the program no longer satisfies the section, a modification application is due within 90 days.
