The owner or operator must meet permit conditions ensuring that hazardous constituents detected in ground water from a regulated unit do not exceed their concentration limits in the uppermost aquifer beyond the point of compliance during the compliance period. The permit sets: the hazardous constituents (264.93: Part 261 Appendix VIII constituents detected in the uppermost aquifer and reasonably expected to derive from the waste, excluding those the Regional Administrator finds pose no substantial hazard after weighing effects on ground-water and hydraulically connected surface water); concentration limits (264.94: background, the Table 1 maximum where background is lower, or an alternate concentration limit set on the listed factors); the point of compliance (264.95: a vertical surface at the hydraulically downgradient limit of the waste management area, including liners and dikes, or a line circumscribing several regulated units); and the compliance period (264.96: years equal to the active life of the waste management area including pre-permit activity and closure, starting when compliance monitoring begins and extended during corrective action until the standard has not been exceeded for three consecutive years).
