An owner or operator seeking a permit to treat, store or dispose of hazardous waste must institute corrective action as necessary to protect human health and the environment for all releases of hazardous waste or constituents from any solid waste management unit at the facility, whenever the waste was placed. The permit specifies the corrective action (with Subpart S), schedules of compliance where it cannot be completed before issuance, and financial assurance for completing it. Corrective action must extend beyond the property boundary where necessary to protect human health and the environment, unless the owner or operator shows that despite best efforts it could not obtain permission, which does not relieve it of responsibility for releases beyond the boundary. The section does not apply to remediation waste management sites unless part of a permitted facility managing non-remediation hazardous waste.
