Under a corrective action program the owner or operator must bring regulated units into compliance with the ground-water protection standard by removing hazardous constituents or treating them in place as the permit specifies, beginning within the permit's time after the standard is exceeded; run a monitoring program at least as effective as compliance monitoring to show the corrective action works; remove or treat in place constituents above their limits between the compliance point and the downgradient property boundary and beyond the boundary where needed to protect human health and the environment, unless permission to act off site could not be obtained despite best efforts (which does not relieve responsibility for the release), within a reasonable time and until concentrations fall below the limits; continue during the compliance period and, if still under way at its end, for as long as needed to meet the standard (corrective action continued beyond a period equal to the active life may end once monitoring shows the standard has not been exceeded for three consecutive years); report annually in writing to the Regional Administrator on effectiveness; and apply within 90 days for a permit modification if the program no longer satisfies the section.
