On a discharge of hazardous waste during transport, the transporter must take appropriate immediate action to protect human health and the environment (for example notifying local authorities and diking the discharge area). A government official acting within official responsibilities may authorise immediate removal by transporters without EPA identification numbers and without a manifest. Air, rail, highway and water transporters must give notice to the National Response Center where 49 CFR 171.15 requires and report in writing under 49 CFR 171.16 to DOT; bulk water transporters must also give the notice required by 33 CFR 153.203.
