Part 736: General prohibitions – EAR - Export Administration Regulations

EAR - Export Administration Regulations 736.2(b)(2): General Prohibition Two: foreign-made items with more than de minimis U.S. content

Without a licence or licence exception, no one may reexport or export from abroad a foreign-made commodity incorporating controlled U.S.-origin commodities (or bundled with controlled U.S. software), foreign software commingled with controlled U.S. software, or foreign technology commingled with controlled U.S. technology, where the item needs a licence under the EAR and the controlled U.S. content exceeds the de minimis levels of 734.4; for Chart-based controls the item's own ECCN reason and the destination decide. A Part 740 exception whose terms are met supersedes it.
