Part 736: General prohibitions – EAR - Export Administration Regulations

EAR - Export Administration Regulations 736.2(b)(1): General Prohibition One: exports and reexports of controlled items to listed countries

Without a licence or licence exception, no item subject to the EAR may be exported, and no U.S.-origin item reexported, where the item is controlled for a reason stated in its ECCN and the Country Chart in Part 738 requires a licence for that reason to the destination; the scope turns on correct classification and the ultimate destination, some controls sit outside the Chart, and any Part 740 exception whose terms are all met supersedes the prohibition.
