An accredited retailer may hold CDR data collected under Division 4.3 as a data holder rather than an accredited data recipient only where the data is of the kinds for which retailers are designated data holders (items 1, 3 or 5 of section 12 of the energy designation), the consumer is its customer, it reasonably believes the data is relevant to the arrangement, and it asked the consumer to agree after explaining that accredited data recipient safeguards would stop applying and data holder safeguards would apply, how it would treat the data, why it may offer the option and the consequences of not agreeing, and the consumer agreed. Related authorisations then expire.
