Australian Education Services for Overseas Students Act 2000 and National Code 2018 (Australia) s47B-47D: ss 47B to 47D Student default: written agreement and refund within 4 weeks

A provider must enter a written agreement with each overseas or intending overseas student setting out the refund requirements if the student defaults and meeting the Code's requirements. When a student defaults (does not start, withdraws, or is refused a course for non-payment, visa breach or misbehaviour) the provider must pay the refund the agreement requires, to the student or a specified person, within 4 weeks of a written claim, subject to the visa refusal exception.
