A registered provider must not engage in misleading or deceptive conduct in recruiting overseas students or providing courses to them, and must be an Australian resident or a Table C provider. It must tell its ESOS agency as soon as practicable when it learns that an associate or high managerial agent has convictions, sanctions, cancelled approvals, conditions or related compliance action of the listed kinds, and within 10 business days of an event that would significantly affect its ability to comply, including prospective ownership changes before they take effect, changes in related persons, and ownership or control links between the provider and an education agent.
