Australian Education Services for Overseas Students Act 2000 and National Code 2018 (Australia) s28-29: ss 28 and 29 Tuition fee account and protected amount

A provider that receives tuition fees before a student starts must keep an account with an Australian ADI, pay those fees into it within 5 business days, and keep at all times at least the protected amount, enough to repay every such student who has not yet begun. Withdrawals below that amount are allowed only for refunds under ss 46D, 47D or 47E, to pay an alternative course provider, or to pay the TPS Director.
